Applies to: Canada.
For a Canadian residential transaction, your name appears on title in your capacity as trustee of the trust. This trustee capacity is an important part of the answer when you ask whose name will be registered.
What are the roles in the trust?
At setup, you hold the roles described in the arrangement as grantor or settlor, beneficiary and trustee. Ijara CDC is then added as a co-trustee and acts as the trust's manager for the life of the transaction.
A trust has distinct roles, so asking “Who owns the trust?” is different from asking whose name appears on the property title or who manages the arrangement. Your trust and closing documents explain those roles for your property.
Before closing, ask your processing team and the lawyer handling your transaction to confirm the exact registered-title wording and your capacity in each document. You can also use the document review page to request the relevant sample trust documents.
