Applies to: Canada.
The Canadian arrangement is described as having no sharing of property gains, while loss may be borne by both parties in some circumstances. This does not establish an automatic percentage split or mean that every decline in the property's value will be shared.
How can I understand my situation?
Ask for an explanation based on the scenario you are considering—for example, a sale at a lower value or completion of the arrangement when the property's value has fallen. Identify the relevant agreement and ask which provisions determine each party's position.
A change in market value, an insurance claim and a payment default raise different questions. The explanation for one situation should not be used to calculate the outcome of another. Your Ijara team can help arrange a review of the relevant contract terms; do not assume a valuation change automatically reduces an outstanding amount.
